These Terms of Service apply to your use of the Clinictus platform, including Clinictus.com, mobile experiences, user dashboards, treatment request flows, clinic/hospital/doctor profiles, online consultation tools, travel and accommodation tools, culture tours/experiences, affiliate/partner programs, and support services.
Clinictus is a technology platform that helps patients organize medical tourism and digital health journeys by connecting them with independent clinics, hospitals, doctors, experts, and selected travel/experience partners. Clinictus is not an emergency medical service, hospital, clinic, travel agency, or tour operator; however, for some transactions Clinictus may act as a technical intermediary, payment facilitator, referral/affiliate partner, or customer support point.
1. Acceptance and eligibility
By using the platform, you accept these Terms, our Privacy Policy, and any additional terms shown during a specific transaction. You may use the platform only for lawful purposes. Minors should use the platform only under the supervision and consent of a parent or legal guardian.
If you have a medical emergency, do not use Clinictus; contact local emergency services or an authorized healthcare institution immediately.
2. Healthcare services and medical responsibility
Clinictus does not diagnose, treat, provide medical services, guarantee treatment outcomes, or replace healthcare professionals. Clinic, hospital, doctor, expert, package, price, image, review, rating, and description information on the platform is for information and comparison purposes.
Medical assessment, diagnosis, treatment planning, surgery, prescriptions, care, complication management, patient acceptance, and medical documentation are the responsibility of the relevant independent healthcare provider. Before accepting any treatment, you should review the provider's identity, authority, clinical conditions, risks, price, cancellation/refund terms, and suitability for your own health condition.
3. Treatment requests, offers, and communications
Patients may create treatment requests, share documents, receive offers, message clinics/hospitals/doctors, and use online consultations where available. Providers should only see their own offers and communications; competing providers should not see each other's commercial offer details.
Clinictus may control profile and request visibility and may remove misleading, unlawful, spam, fake, abusive, discriminatory, or medically unsafe content, suspend accounts, or place requests under review.
4. Payments, fees, invoices, and commissions
Some payments may be completed through Clinictus, while others may be completed directly through the relevant clinic, hospital, doctor, expert, or third-party travel/experience provider. The payment route, currency, service scope, taxes, invoice, refund, and cancellation terms are governed by the transaction terms shown before payment.
A Clinictus receipt or booking summary is not a fiscal invoice unless expressly stated. The official invoice for a healthcare or travel service should be issued by the clinic, hospital, doctor, hotel, tour operator, travel provider, or other responsible commercial party providing that service.
Clinictus may receive service fees, platform fees, affiliate revenue, or commissions from certain transactions. These commercial arrangements form part of the platform's business model where the total price and transaction terms are shown clearly.
5. Travel, hotel, flight, transfer, and experience services
Clinictus may list or provide access to flights, hotels, transfers, tours, museums, wellness/activities, and similar travel services to support the healthcare journey. These services are often supplied by independent third-party providers or technology/affiliate partners.
- LiteAPI / Nuitee Travel Limited: Hotel search, pricing, availability, booking, payment SDK, cancellation/refund data, and booking documents may be provided through the relevant supplier infrastructure. Even where Clinictus provides panel tools, Clinictus is not the hotel operator or final accommodation provider.
- Viator: Tour and experience content may be provided by Viator or its connected suppliers. In Basic/affiliate flows, payment and booking may be completed on Viator or supplier systems; Viator's or the supplier's terms, vouchers, support, cancellation, and refund conditions apply.
- Travelpayouts: Flight and certain travel tools may use Travelpayouts affiliate/white-label technology. At the final purchase step, users may be redirected to an airline, OTA, advertiser, or travel provider; fares, ticketing, baggage, changes, cancellations, and customer support are subject to that provider's terms.
Clinictus does not guarantee third-party stock, prices, availability, visa/entry rules, flight changes, overbooking, local hotel fees, city taxes, supplier cancellations, airline rules, tour operator decisions, or local service quality. Users should review supplier terms and travel requirements before purchase.
6. Cancellations, refunds, and changes
Cancellation and refund rights vary by service type, provider, country, payment method, rate type, and transaction terms shown at purchase. Non-refundable, partially refundable, prepaid, last-minute, promotional, or special-rate transactions may result in all or part of the price being retained.
Clinictus may provide tools that send cancellation requests to the relevant partner API for some bookings. However, refund amount, cancellation eligibility, exchange rate effects, bank deductions, supplier service fees, and refund timing may be determined by the relevant provider/payment institution.
7. User obligations
Users must provide accurate, current, and lawful information; protect their accounts; avoid sharing another person's health, identity, payment, or travel data without permission; upload medical documents only when necessary; avoid misuse of the platform; and respect third-party rights.
Clinics, hospitals, doctors, experts, and partners must comply with licensing, authorization, advertising, patient information, pricing, healthcare claims, data protection, and consumer laws. Misleading success guarantees, false before/after images, unauthorized patient data sharing, and aggressive marketing are prohibited.
8. Content, reviews, and platform safety
Users are responsible for the text, images, documents, reviews, offers, and messages they upload. Clinictus may review, remove, limit visibility, or suspend accounts where required by applicable law or platform safety needs.
Where applicable under the EU Digital Services Act and similar platform rules, illegal content notices, account restrictions, and appeal requests may be handled through our support channels.
9. Affiliate and partner programs
Affiliate or partner users may refer patients to Clinictus. Partners must not make misleading health claims, medical guarantees, fake discounts, unauthorized brand use, spam, personal data violations, or unlawful advertising. Commissions arise only when Clinictus-defined eligible lead, payment, and treatment milestones are met.
10. Intellectual property
The Clinictus brand, designs, software, data structure, texts, logos, and platform components belong to Clinictus or its licensors. Your use of the platform does not grant ownership or unauthorized commercial use rights.
11. Limitation of liability
Subject to mandatory consumer and data protection rights, Clinictus is not responsible for independent healthcare providers' medical decisions, third-party travel providers' booking/payment/cancellation processes, user-provided inaccurate information, force majeure, technical interruptions, supplier price changes, or indirect losses arising from users' own decisions.
Nothing in these Terms excludes liability that cannot be limited under applicable law, including intentional misconduct, gross negligence, death/personal injury, consumer rights, or data protection rights.
12. Applicable law and disputes
Clinictus aims to comply with applicable mandatory consumer, digital services, healthcare advertising, and data protection rules in the European Union/EEA, Türkiye, and the United Kingdom where relevant to its services. These Terms are interpreted together with the law of the jurisdiction where the Clinictus operating entity is established and any mandatory EU/EEA, Turkish, and UK rules that apply to you.
Disputes should first be raised through our support channels. Mandatory consumer complaint routes, data protection authority complaints, and court rights remain unaffected.
13. Changes and contact
Clinictus may update these Terms as products, partners, payment flows, legal requirements, or security needs change. Material changes will be communicated where appropriate. For questions, create a support ticket or contact us through the contact page.
